The Impact of Discriminatory Local Regulations on Access to Public Services

This document is the Executive Summary (Executive Summary) of a legal research report published by the SETARA Institute titled “The Impact of Discriminatory Local Legal Provisions on Access to Public Services”. The field research and legal analysis for this report were conducted between September 2018 and February 2019, focusing on the Special Region of Yogyakarta (DIY) and West Java.

This three-page summary identifies and critically analyzes local legal instruments (Perda/Perkada) deemed to be discriminatory. This study examined 24 legal instruments in Yogyakarta and 91 in West Java, identifying 32 regulations that explicitly discriminate against marginalized groups based on gender, ethnicity, belief/religion, and sexual orientation. The report highlights the detrimental impact of these regulations, which restrict the constitutional rights of minorities to access equitable public services. In addition to conducting interviews with affected communities, this research also analyzed more than 400,000 public complaint records collected through the national complaint handling system, SP4N-LAPOR!.
